By entering or otherwise participating in any Giveaway (“Promotion”) run by Zapped E-Rides (“Sponsor”), you agree to comply with and be bound by these Official Rules, which constitute a legal contract. Therefore, you should read these rules carefully before entering. This contract requires you to indemnify and hold harmless the Sponsor and its affiliates and to release all claims against them. By entering, you agree to resolve any disputes through mandatory, binding arbitration, and you waive any right to participate in a class action. You also agree to limitations of your rights and remedies, including any damages you may recover.

2. Eligibility

Open only to legal residents of the 48 contiguous United States (“Lower 48”), excluding Alaska, Hawaii, U.S. territories, and overseas military installations.

Entrants must be of the legal age of majority in their state of residence at the time of entry (18 in most states, 19 in Nebraska, and 21 in Mississippi).

A parent or legal guardian may submit an entry on behalf of a minor; in such cases, the parent or guardian will be considered the official entrant and, if selected, will be awarded the prize.

Employees, officers, and directors of Sponsor, its parent, subsidiaries, affiliates, and immediate family members or those living in the same household are not eligible to participate.

Entrants must meet all legal requirements in their state or jurisdiction to receive and use the prize.

Giveaway is void where prohibited by law.
3. Winner Selection & Notification

Winners will be chosen at random from all eligible entries. Odds of winning depend on the number of entries received.

Winners will be notified by a reply from the official Zapped E-Rides YouTube account only.

To verify identity, the winner must add their email address to their YouTube bio. Sponsor will then contact the winner from support@tbelectricmoto.com.

No other accounts, emails, phone calls, or messages are valid. Do not respond to anyone else claiming you won.

Winner must respond within 7 days of being contacted. If the winner does not respond, is found ineligible, or violates these rules, the prize may be forfeited, and an alternate winner may be selected.
4. Prizes

The prize(s) for each Giveaway will be described in the official Giveaway announcement.

All prizes are awarded free of charge.

No substitutions, cash equivalents, or transfers are permitted, except at Sponsor’s sole discretion.

Sponsor reserves the right to substitute a prize of equal or greater value if the stated prize becomes unavailable.

Prizes will be shipped free of charge to addresses within the Lower 48 states. Sponsor is not responsible for delays, shipping issues, or delivery failures outside its control.
5. Taxes

Winners are solely responsible for any federal, state, or local taxes associated with acceptance or use of the prize.

If required by law, Sponsor may issue an IRS Form 1099-MISC for the fair market value (FMV) of the prize.

Winners are responsible for reporting and paying any applicable taxes directly to the IRS or relevant tax authority.
6. Publicity & Privacy

By accepting a prize, winners grant Sponsor and its affiliates the right to use their name, likeness, voice, statements, city, and state for advertising, publicity, and promotional purposes in any media, worldwide, without limitation or additional compensation, unless prohibited by law.

By entering, participants agree that Sponsor may use submitted personal information for the administration of the Giveaway and in accordance with its Privacy Policy.
7. Scam Alert

Sponsor will never ask winners for credit card numbers, banking details, or payments of any kind.

The only valid contact will be from the official Zapped E-Rides YouTube account and email support@tbelectricmoto.com.

Any requests for payment or other contact claiming affiliation with the Giveaway are fraudulent.
8. Limitation of Liability & Indemnification
By entering, participants agree to release, discharge, indemnify, and hold harmless Sponsor, YouTube, and their respective parents, subsidiaries, affiliates, officers, directors, employees, agents, and representatives (collectively, the “Released Parties”) from any and all claims, damages, losses, or liabilities arising from:

Any technical failures, errors, or malfunctions of hardware, software, networks, or platforms

Any unauthorized human intervention or fraud

Any injury or damage to persons or property related to or resulting from participation
In no event shall the Released Parties be liable for any indirect, incidental, consequential, or punitive damages, even if advised of the possibility of such damages.
9. Dispute Resolution

All disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association in Utah.

Entrants waive any right to participate in class actions or seek class-wide relief.

Any claims, judgments, or awards will be limited to actual out-of-pocket expenses incurred, excluding attorneys’ fees.
10. General Conditions

Sponsor reserves the right to cancel, suspend, or modify any Giveaway if technical issues, fraud, or other factors compromise the integrity of the promotion.

Any attempt to deliberately damage Sponsor’s websites, channels, or platforms, or to undermine the legitimate operation of the Giveaway, may be a violation of criminal and civil laws. Sponsor reserves the right to disqualify and seek damages from anyone engaging in such conduct.
11. Disclaimer

Giveaways are not sponsored, endorsed, administered by, or associated with YouTube or any other social media platform.

By entering, participants agree to comply with YouTube’s Community Guidelines and Terms of Service.

Entries that violate YouTube’s rules will be disqualified.
12. Governing Law
All Giveaways are governed by the laws of the State of Utah, without regard to conflict of law principles. Entrants agree that Utah courts (if arbitration is deemed unenforceable) will have jurisdiction.
